Resident organisations raise issue of rampant encroachment in Noida societies, apartments

Noida, 11th August, 2022: Unauthorized construction is currently a major issue in Noida. RWAs from various sectors complain that unauthorised extensions infringe on common spaces through temporary or permanent constructions, whether in sectors, gated colonies, or condominiums. They claim, however, that no action is being taken against them.

The issue has come to spotlight after Shrikant Tyagi, an Omaxe Grande society resident who claimed to be a BJP member, allegedly abused and heckled a lady while trying to encroach on the common area of a society. Tyagi threatened and abused a resident who had objected to his alleged encroachment on the society’s common area.

The entire incident was captured on the society’s CCTV. Following an uproar on social media, a team from Noida Authority arrived on the scene and removed all of his illegal encroachments.

The president of the Noida Federation of Apartment Owners’ Association (NOFAA), Rajiva Singh, says,”Most high-rise societies have issues with residents changing things to building flats that are not in accordance with the UP Apartment Act’s model bylaws.”

Such encroachments include enlarging balconies for more space, extending garden areas for bottom-floor residents, designating it as their own personal space, and so on. As a result, conflicts arise between the AOA’s and the defaulting residents.”

He also emphasised the importance of regular communication between resident bodies and administration in preventing the spread of such issues.

Furthermore, digitising AOA/RWA records and portals for escalating disputes in individual societies can help to reduce the number of unfortunate instances in which residents and the AOA are involved.

According to Sanjeev Kumar, general secretary of Sector 51 RWA and senior vice president of DDRWA, “People have planted gardens, boundary walls, or trees on government land outside the plot, Kothi, or flat in sectors. These people conduct business in the neighbourhood. Noida Authority and Noida Police both prohibit some of these activities but still the practice isn’t stopping entirely.”

He also claims that there are numerous cases of misbehaviour and unruly behaviour by members of society (such as the recent Tyagi incident in which he abused a female resident).

He further claimed that, despite persistent requests from RWA, Federation, or AOA, Noida Authority only issues notices and does not take appropriate action.
